VILLAGE OF RIDGEWOOD NOTICE OF PENDING ORDINANCE ORDINANCE NO. 3379 The ordinance published herewith was introduced and passed upon first reading at a meeting of the Village Council of the Village of Ridgewood, in the County of Bergen, New Jersey held on April 10, 2013.

It will be further considered for final passage, after public hearing thereon, at a Regular Public Meeting of said Village Council to be held in the Courtroom of the Ridgewood Village Hall 131 N. Maple Avenue, Ridgewood, NJ 07450 on May 8, 2013 at 8:00 PM., and during the week prior to and up to and including the date of such meeting, copies of said ordinance will be made available at the Village Clerk's Office in said Village Hall, 131 N. VILLAGE OF RIDGEWOOD ORDINANCE NO. 3379

AN ORDINANCE TO AMEND CHAPTER 269 OF THE CODE OF THE VILLAGE OF RIDGEWOOD, WATER, AT SECTION 269-48, "REGULATIONS"

BE IT ORDAINED by the Village Council of the Village of Ridgewood:

Section 1. Chapter 269, Water, of the Code of the Village of Ridgewood is hereby amended as follows:

ADD Chapter 269, Section 269-48, "Regulations"

The following water emergency regulations are hereby adopted to become effective as set forth herein:

A. The stages shall be as follows:

Level I: Moderate Mandatory restriction of irrigation to Tuesdays, Thursdays, and Saturdays for properties with odd-numbered addresses and Wednesdays, Fridays, and Sundays for properties with even-numbered addresses. Irrigation using a hand-held hose shall be allowed at any time. No irrigation shall be allowed on Mondays except for the use of a hand held hose.

Level II: Severe Mandatory restriction of irrigation to Tuesdays and Saturdays for properties with odd-numbered addresses and Wednesdays and Sundays for properties with even- numbered addresses. No irrigation shall be allowed on Mondays, Thursdays, or Fridays except for the use of a hand held hose. Irrigation using a hand held hose shall be allowed at any time.

Level III: Pending/Critical Mandatory restriction of irrigation to the use of a hand held hose on Tuesdays and Saturdays for properties with odd- numbered addresses and Wednesdays and Sundays for properties with even-numbered addresses. No irrigation of any kind shall be allowed on Mondays, Thursdays, or Fridays.

Level IV: Critical Irrigation is prohibited at any time. Exceptions for irrigation using a hand held hose may be allowed under conditions prescribed by the Village Manager of the Village of Ridgewood.

B. Stage I, Stage II, Stage III and Stage IV emergency regulations shall become effective upon declaration of each stage by the Village Manager of the Village of Ridgewood. Stage I shall become effective without such declaration on June 1 of each year and shall remain in effect through August 31 of that year except for any period where Stage II, Stage III, or Stage IV emergency regulations are declared. Exceptions to the user restrictions, such as for irrigation of newly planted lawns or shrubs, for cleaning cars or houses, for filling swimming pools or other such outdoor water usage, shall be determined by the Village Manager of the Village of Ridgewood or a Village of Ridgewood employee designated by the Village Manager. Use of any private well shall be exempt from these regulations, provided that said well is first registered with the local Health Authority.

269-49. Discontinuance of water supply to premises in violation. If any person, whether an inhabitant of the Village of Ridgewood or Township of Wyckoff or of the Boroughs of Glen Rock or Midland Park, shall violate any provision of this article, the Village Department of Water Supply shall have the right and it is hereby empowered to cut off the supply of water to the premises and meter upon and from which such violation shall have taken place for such period or periods of time as shall be deemed necessary to secure compliance with all the terms of this article.

269-50. Enforcement. The enforcement of the provisions of this article shall be the responsibility of the Director of Water Supply, its Business Manager, Chief Operator, Superintendent of Distribution, Chief Engineer, Property Management Officer, any duly sworn member of the Village of Ridgewood Police Department, and any other officer and/or Village employee duly appointed by the Village Manager.

DELETE: Chapter 269, Section 269-48, "Regulations"

The following water emergency regulations are hereby adopted to become effective as set forth herein: A. The stages shall be as follows: Stage of Drought Emergency Emergency Regulation Condition User Restrictions I Precautionary- minor Mandatory restriction of irrigation limited to alternate days, as hereinafter defined. Irrigation using a hand-held hose shall be allowed at any time. II Moderate Mandatory restriction of irrigation limited to alternate days as defined further herein. Irrigation using a hand-held hose shall be allowed at any time with the following exception: There shall be no irrigation of any kind allowed on Mondays. III Moderate - severe Mandatory restriction of irrigation limited to alternate days as defined further herein and between the hours of 7:00 a.m. to 9:00 a.m. and 7:00 p.m. to 9:00 p.m. for manual sprinkler systems and between the hours of 1:00 a.m. to 4:00 a.m. for automatic in-ground sprinkler systems. Irrigation using a hand-held hose shall be allowed at any time. There shall be no irrigation of any kind allowed on Mondays. IV Severe - critical Prohibit irrigation at any time. Irrigation using a hand-held hose may be allowed under conditions prescribed by the Village Manager of the Village of Ridgewood.

B. Stage I, Stage II, Stage III and Stage IV emergency regulations shall become effective upon declaration of each stage by the Village Manager of the Village of Ridgewood. "Alternate day irrigation" shall be defined as follows: Irrigation of properties with odd-numbered addresses shall be permitted on odd-numbered days, while irrigation of properties with even-numbered addresses shall be permitted on even-numbered days. Exceptions to the user restrictions, such as for irrigation of new lawns or shrubs, for cleaning cars or houses, for filling swimming pools or other such outdoor water usage, shall be determined by the Village Manager of the Village of Ridgewood. Private wells shall be exempt from these regulations, provided that said well is first registered with the Local Division of Health of the serviced community.

269-49 Discontinuance of water supply to premises in violation. Section 2: Except as herein amended and supplemented, Chapter 269, of The Code of the Village of Ridgewood, remains in full force and effect.

Section 3: This ordinance shall take effect immediately upon passage and publication as required by law.
