MP Officer Wins DWI Appeal
Suspended Midland Park Police Officer Joseph B. Gaeta won his appeal for drunk driving charges involving an ATV accident in Wyckoff, according to a report in northjersey.com. The Dec. 15, 2011 accident took place following a DWI training class where Gaeta was a test subject fed alcoholic beverages to demonstrate how field sobriety test performance deteriorates at varying degrees of intoxication.
Later that afternoon, his blood alcohol level was reportedly .135 when he crashed an all-terrain vehicle and sustained serious facial injuries. He plead guilty to DWI, appealed and lost, then appealed again and won.
The decision, issued this week, was based on a state law amended in 2009, but not implemented until 2013, to apply the same DWI penalty to ATV drivers as standard vehicles. Since the accident occurred in 2011, Gaeta was given a lesser penalty. His attorney expects Gaeta will be reinstated to the Midland Park Police Department. Is is currently suspended without pay.
